§ 1. General provisions
- These Terms govern use of the LunchOut service available at lunchmap.pl, including the public lunch-menu finder and map as well as the admin panel for owners and operators of restaurants, bars and similar venues.
- LunchOut is a technology platform and data aggregator, not a restaurant operator. The Service provides software that helps find lunch-menu information and contact venues. We are not a party to contracts concluded at a venue chosen by a Visitor.
- The service administrator and provider of electronic services is Kevin Pietrzyk, z siedzibą pod adresem: Juliusza Lea 219/7, 30-133 Kraków, NIP 6772467132, REGON 389678166, e-mail: admin@lunchout.pl (the “Administrator”).
- These Terms are made available free of charge before account registration and form an integral part of the electronic-services agreement concluded with the User upon acceptance during registration. Use of the public part of the Service (map, finder) does not require registration.
- Definitions:
- Service – the LunchOut platform, including the lunch map, public SEO pages and the admin panel.
- User – a natural or legal person using the Service, in particular a venue owner or operator with an Account.
- Visitor – a person using the public part of the Service (without an Account or without signing in), including the map and lunch-menu lists.
- Community signal – a voluntary mark submitted in the Service, e.g. liking a venue.
- Account – an individual User account in the admin panel, activated by the Administrator after registration.
- Venue data – information about a venue entered by the User or obtained from public sources, including name, address, opening hours, lunch menus, contact details and content published on social media.
§ 2. Registration and User account
- Registration requires an e-mail address and password, acceptance of these Terms and review of the Privacy Policy.
- An Account remains inactive until activated by the Administrator. The Administrator may refuse activation without stating a reason, in particular where there are doubts as to identity or accuracy of data.
- The User undertakes to provide true and up-to-date data and to keep them current.
- The User is responsible for keeping the Account password confidential and for all actions taken using the Account.
- One User may manage one or more venues according to permissions granted in the Service.
§ 3. Scope of services
- The Service operates in two tracks: as a data aggregator (finder) and as an admin panel for venues that voluntarily take control of their listing.
- The Service enables the User, among other things, to manage a venue profile, publish lunch-menu information, integrate with social media (Facebook, Instagram – if configured) and appear in the LunchOut finder.
- The Administrator may modify Service features, including adding, changing or removing functions, with a reasonable notice period for material changes affecting how services are used.
- Basic services may be free or paid — current terms are set out on request or in a separate agreement with the Administrator. Use of the basic public finder by Visitors is free of charge.
- The public part of the Service enables Visitors to search for lunch venues and submit community signals. Those signals do not replace official confirmation of a menu by the venue.
§ 3a. Finder and aggregation of public data
- Before a venue joins as an active Partner (takes over its listing in the panel), its profile may appear in the Service database within the finder and map. We operate similarly to popular internet search engines, indexing and organising information available online.
- Data source: some venue profiles (including name, address, hours or lunch-menu information) may be created autonomously from publicly available Internet information (e.g. venue websites, public social-media posts). This helps Visitors find public information in one central place.
- Notice & Takedown: we respect the wishes of venue owners and operators. If you represent a venue and do not want it listed in the public LunchOut finder (or want to update or take over a profile), we offer a prompt removal or update procedure — write to admin@lunchout.pl. After confirming authority to represent the venue, the Administrator promptly disables public visibility of the listing.
- The Administrator may also provide the owner with a direct opt-out link. The effect of a request is removal of the venue from the map and search results.
§ 3b. Community signals
- Visitors and Users of the public part of the Service may voluntarily submit community signals (e.g. liking a venue).
- When submitting a signal, you declare that it is based on a genuine contact with the venue or your own honest assessment. Misleading other users, mass or false marks, and abusing features to manipulate rankings or counters are prohibited.
- Community signals are auxiliary and informational. The Administrator does not individually verify every mark before publishing aggregated counters.
- The Administrator may remove, hide or ignore signals (in whole or in part), limit the ability to submit them and take technical measures against abuse — without prior notice where justified by Service security or third-party rights.
- Details of processing data related to community signals are set out in the Privacy Policy.
§ 4. User obligations
- The User undertakes to use the Service in accordance with the law, these Terms and good practice.
- It is prohibited to enter into the Service content that is unlawful, including content that infringes copyright or personal rights, or that is vulgar, discriminatory or misleading.
- The User bears sole responsibility for venue content and data entered into the Service, including accuracy of published lunch menus, prices and availability.
- Lunch-menu information shown to end users (map, SEO pages) may include posts confirmed by the venue as well as content collected from public sources. Unconfirmed or outdated information is not a guarantee of the current offer.
- The User undertakes not to take actions that may disrupt the Service, including unauthorised access attempts to the Administrator’s systems.
- Section 3b on community signals applies mutatis mutandis to Visitors using the public part of the Service.
§ 5. Personal data processing
- The controller of Users’ personal data is Kevin Pietrzyk, z siedzibą pod adresem: Juliusza Lea 219/7, 30-133 Kraków, NIP 6772467132, REGON 389678166, e-mail: admin@lunchout.pl.
- Detailed information on personal-data processing, including purposes, legal bases, retention, recipients and User rights, is set out in the Privacy Policy (GDPR information clause).
- In connection with registration and Account operation the Administrator processes in particular:
- e-mail address (login),
- password (encrypted),
- date and content of consents,
- venue data entered by the User,
- technical data (IP address, system logs) — for security and accountability.
- The legal basis for processing data necessary for registration and service delivery is Art. 6(1)(b) GDPR (performance of a contract). Data are stored for the term of the contract and for periods required by law or until claims expire.
- The User has the right of access, rectification, erasure, restriction, data portability, objection and complaint to a supervisory authority. Details in the Privacy Policy.
- Providing data marked as required is voluntary but necessary to create and use an Account.
§ 6. Copyright and licence
- All elements of the Service (software, layout, logo, databases) are legally protected and belong to the Administrator or its licensors.
- The User grants the Administrator a non-exclusive, royalty-free licence to use venue content and data entered into the Service to the extent necessary to provide services, promote the Service and present the venue to end users.
§ 7. Liability
- The Administrator endeavours to keep the Service working properly but does not guarantee uninterrupted or error-free operation. Software is provided on an “AS IS” basis.
- The Administrator is not liable for damage resulting from use of or inability to use the Service, unless the damage results from the Administrator’s wilful misconduct.
- The Administrator is not liable for content entered by Users or for a User’s decisions regarding menus, prices or availability at the venue.
- Despite technological efforts, including automatic synchronisation and indexing of public data, LunchOut is an information tool. The Administrator bears no legal or civil liability for incorrectly aggregated data, outdated lunch menus, errors in descriptions from public sources or Users, or damage arising directly at venues. The service provider for the Visitor remains the venue itself.
- The Administrator is not liable for community signals submitted by Visitors or Users, including their truthfulness, currency or consequences of relying on them. Responsibility for the accuracy of a mark rests with the person who submitted it.
§ 8. Suspension and deletion of account
- The Administrator may suspend or delete a User Account in case of breach of these Terms, the law or the Administrator’s legitimate interest, with the possibility of a prior request to remedy the breach.
- The User may at any time request Account deletion by contacting admin@lunchout.pl. Deletion does not affect the Administrator’s right to retain data as required by law.
§ 9. Complaints
- Complaints about the Service should be sent to admin@lunchout.pl.
- The Administrator reviews complaints within 14 days of receipt and informs the User of the outcome.
§ 10. Final provisions
- The Administrator may amend these Terms. Users with an Account will be informed of material changes with appropriate notice (e.g. by e-mail or a panel message).
- Matters not covered are governed by Polish law, in particular the Act on Providing Services by Electronic Means and the GDPR.
- Disputes shall be resolved by the court competent for the Administrator’s registered office, unless mandatory provisions state otherwise.
